E-Verify – MOU
The Beason-Hammon Alabama Taxpayer and Citizen Protection Act (Alabama Act 2011-535) requires all employers within the State of Alabama to verify the legal presence of their employees. This is a requirement for contracts with non-governmental business entities or employers employing one or more persons and all professional services contracts between state agencies, state-funded entities, local governments, or governmental units with the state of Alabama.
Verification is accomplished through registration in the federal E-Verify program at the U.S. Department of Homeland Security's website, or for Alabama businesses with 25 or fewer employees, there is an additional option to complete verification through the Alabama Department of Homeland Security’s E-Verify Employer Agent Service. Instructions for enrollment in the Alabama E-Verify Employer Agent Service are provided at this link, or you may contact Alabama E-Verify directly using the information provided below.
Once enrolled through either website, the E-Verify system will generate an E-Verify Memorandum of Understanding (MOU) for the employer, bearing an assigned number. A complete copy of that MOU must be submitted to the Alabama Department of Public Health by all providers participating in ABCCEDP, confirming enrollment in the E-Verify program. Failure to do so can result in delays in processing the Contract and restrict the employer's ability to provide services for the ABCCEDP.
